Last updated: 30 September 2026
1. About these terms
Arcana is a trading name of Maria Soledad Moran González, EI (entrepreneur individuelle), SIRET 931 873 830 00018, based in Bussy-Saint-Georges, France.
These terms apply to your use of our website, booking pages, and any discovery call or initial consultation with Arcana. By booking a call or using our website, you agree to these terms. Our services are directed exclusively at business clients (B2B). Paid services are governed by a separate written proposal or agreement, which takes priority if it conflicts with these general terms.
2. Our services
Arcana designs and builds CRM and automation systems primarily using GoHighLevel, which may include Instagram automations, landing pages, quizzes, follow-up sequences, and booking calendars. The exact scope, price, deliverables, and timeline for any project are detailed in your individual proposal or agreement.
3. Discovery calls
Discovery calls are a free, no-obligation conversation of approximately 15 minutes to discuss your business needs.
- Booking a call does not create a formal client relationship or obligate either party to purchase or provide services.
- Please reschedule or cancel at least 24 hours in advance using the link provided in your confirmation email.
- We reserve the right to reschedule or cancel a call if necessary and will give you as much notice as possible.
4. No guarantees
We build customized technical systems and automated tools. We do not guarantee any specific number of leads, clients, sales, or revenue figures. Your actual business results depend on many factors outside our control, including your market offer, audience targeting, content quality, and external marketing execution.
5. Prices, payment terms, and VAT
Prices for paid services are set out in your project proposal or agreement.
VAT: Value Added Tax is not applicable pursuant to Article 293 B of the French General Tax Code (TVA non applicable, art. 293 B du CGI).
Late Payments: In accordance with Article L441-10 of the French Commercial Code (Code de commerce), for B2B invoices paid past the due date, late payment interest will apply at the European Central Bank's key refinancing rate plus 10 percentage points. A statutory fixed compensation fee of €40 for recovery costs will also apply automatically to overdue invoices.
6. Your responsibilities
If you become a client, you agree to:
- Provide the necessary content, brand assets, credentials, and information in a timely manner.
- Ensure that all content and data you provide us is legally owned by you or properly licensed.
- Comply with all applicable marketing and privacy laws governing your business, including email and SMS opt-in consent regulations.
- Pay all applicable third-party costs (such as GoHighLevel sub-account fees, phone/SMS usage fees, or domain costs) unless explicitly included in your agreement.
7. Intellectual property
You retain full ownership of your pre-existing content, brand assets, and client data. Unless agreed otherwise in writing, Arcana retains ownership of its proprietary templates, workflows, code, and technical methodology. Upon full payment of all fees, you are granted a non-exclusive license to use the systems configured specifically for your business account.
8. Confidentiality
Both parties agree to keep any non-public business, financial, or technical information shared during calls or projects strictly confidential, and to use such information solely for the purpose of evaluating or delivering our services.
9. Website and third-party tools
We strive to keep our website accurate and functional, but we do not guarantee uninterrupted or error-free operation. Our systems rely on third-party platforms (such as GoHighLevel, Meta/Instagram, and Google). Arcana is not responsible for platform outages, API changes, account restrictions, or policy updates imposed by these third-party providers.
10. Limitation of liability
To the maximum extent permitted by applicable law, Arcana shall not be liable for any indirect, incidental, or consequential damages, including lost profits, lost revenue, or business interruption. Our total aggregate liability for any claim arising out of our website, discovery calls, or services shall be limited to the total fees paid by you to Arcana in the three (3) months prior to the event giving rise to the claim.
Nothing in these terms limits any non-waivable statutory rights you may hold under French law.
11. Governing law and dispute resolution
These terms are governed by and construed in accordance with the laws of France. Any dispute arising out of or in connection with these terms shall be submitted to the exclusive jurisdiction of the competent courts within the jurisdiction of our registered business location in France.
12. Changes
We may update these terms from time to time. The “Last updated” date at the top indicates when changes were made. Your continued use of our website or booking tools constitutes acceptance of the revised terms.
